Why is Charles Taylor’s trial taking place in The Hague? Is it that the Dutch government is more concern about peace around the world?
Citing fears over instability in Liberia if Taylor were tried in neighboring Sierra Leone, Liberian President Ellen Sirleaf-Johnson backed a bid to have Taylor’s trial moved to The Hague, Several radio discussions were held to hear the views of the Sierra Leonean citizen if it is necessary to continue Taylor’s trial in Sierra Leone or taking out of the Country. Many people were in support for Taylor’s trial not to continue in Sierra Leone due to security treat and were afraid for terrorist attack. The Dutch Government been supportive in the peace process in Sierra Leone and one of the countries that spent somuch money in the work of the Special Court asked for a Security Council resolution to authorize the transfer, and said it would host Taylor’s trial on the condition that another country agreed in advance to take Taylor after his trial finished (the United Kingdom agreed).
Security Council Resolution 1688 was passed unanimously on June 16, 2006, paving the way for Taylor to be tried by the Special Court on the premises of the International Criminal Court in The Hague.
According to Article 10 of the Special Court Agreement between the United Nations and the Government of Sierra Leone, while the seat of the Special Court shall be in Sierra Leone, “…The Court may meet away from its seat if it considers it necessary for the efficient exercise of its functions, and may be relocated outside Sierra Leone, if the circumstances so require…” Pursuant to this provision in the Special Court Agreement, the President of the court, who sits as the presiding judge of the Appeals Chamber issued an order that Mr. Taylor’s trial be held in The Hague due to concerns that holding the trial in Sierra Leone might jeopardize security in the West African sub-region, which might in turn have a negative impact on the work of the Special Court.
